Updated Handbook for Employers Now Available |

USCIS published the updated M-274, Handbook for Employers: Guidance for Completing Form I-9 (PDF, 5.36 MB). The Handbook for Employers provides employers with detailed guidance for completing Form I-9, Employment Eligibility Verification. This version dated Jan. 22, 2017, replaces the previous version. It reflects revisions to Form I-9, which was revised on Nov. 14, 2016.
The Handbook for Employers:
- Details how to properly complete the revised Form I-9
- Captures policy and regulatory changes since 2013
- Is written in plain language, so that it is easier to understand
- Includes a streamlined questions and answers section
- Features updated tables, new figures, and more current sample documents
- Explains guidance regarding automatic extensions for certain Employment Authorization Documents

New edition dated 02/07/17. Beginning April 28, 2017, civil surgeons must use the 02/07/17 edition Form I-693 (which shows an expiration date of 02/28/2019 at the top right corner of page 1). USCIS will not accept any previous editions (with an expiration date of 03/31/2017 or earlier) that a civil surgeon signed and dated on or after April 28, 2017.

On Jan. 17, 2017, the final rule amending DHS regulations, "Retention of EB-1, EB-2, and EB-3 Immigrant Workers and Program Improvements Affecting High-Skilled Nonimmigrant Workers," took effect. Our Fact Sheet provides guidance on completing Form I-9, Employment Authorization Verification, with certain Employment Authorization Documents. Read the latest News Alert.
Nearly 7,000 participants registered for the USCIS Form I-9 stakeholder teleconference on Jan. 31, 2017. USCIS engaged with the public to discuss enhancements and answer questions about the revised Form I-9, Employment Eligibility Verification. Employers must use the latest version of Form I-9 dated 11/14/2016, for their new hires and reverifications. All other versions have expired and employers who fail to use the current version on or after Jan. 22, 2017, may be subject to applicable penalties. As of Jan. 18, 2017, the Office of Special Counsel for Immigration-Related Unfair Employment Practices within Department of Justice, Civil Rights Division has been renamed the Immigrant and Employee Rights Section (IER). E-Verify employers may access updated Right to Work posters in English and Spanish. For more information, visit IER's website.

DHS announced an 18-month extension of Temporary Protected Status benefits for beneficiaries of TPS under the designations of Yemen, from March 4, 2017, through Sept. 3, 2018; and Somalia, from March 18, 2017, through Sept. 17, 2018. For employer guidance, visit I-9 Central's Temporary Protected Status page.

Employers enrolled in E-Verify can request authorization to post the trademarked E-Verify logo on your website and printed materials. Visit the Trademark and Logo Usage Guidelines webpage for more information and to submit the request.

Have you been using E-Verify more than 10 years? If yes, please download the new Historic Records Reports by March 31, 2017.
In April 2017, USCIS must dispose of transaction records that are over 10 years old. We have created a Historic Records Report that contains transaction records dated on or before Dec. 31, 2006. E-Verify employers may download these records from now through March 31, 2017.
E-Verify encourages you to record the E-Verify case verification number on the relating Form I-9, Employment Eligibility Verification, and to retain the Historic Records Report with Form I-9.

USCIS Will Temporarily Suspend Premium Processing for All H-1B Petitions |

Starting April 3, 2017, USCIS will temporarily suspend premium processing for all H-1B petitions. This suspension may last up to 6 months. While H-1B premium processing is suspended, petitioners will not be able to file Form I-907, Request for Premium Processing Service for a Form I-129, Petition for a Nonimmigrant Worker which requests the H-1B nonimmigrant classification. We will notify the public before resuming premium processing for H-1B petitions.
Who Is Affected
The temporary suspension applies to all H-1B petitions filed on or after April 3, 2017. Since FY18 cap-subject H-1B petitions cannot be filed before April 3, 2017, this suspension will apply to all petitions filed for the FY18 H-1B regular cap and master's advanced degree cap exemption (the "master's cap"). The suspension also applies to petitions that may be cap-exempt.
While premium processing is suspended, we will reject any Form I-907 filed with an H-1B petition. If the petitioner submits one combined check for both the Form I-907 and Form I-129 H-1B fees, we will have to reject both forms.
We will continue to premium process Form I-129 H-1B petitions if the petitioner properly filed an associated Form I-907 before April 3, 2017. Therefore, we will refund the premium processing fee if:
- The petitioner filed the Form I-907 for an H-1B petition before April 3, 2017, and
- We did not take adjudicative action on the case within the 15-calendar-day processing period.
This temporary suspension of premium processing does not apply to other eligible nonimmigrant classifications filed on Form I-129.
Requesting Expedited Processing
While premium processing is suspended, petitioners may submit a request to expedite an H-1B petition if they meet the criteria on the Expedite Criteria webpage. It is the petitioner's responsibility to demonstrate that they meet at least one of the expedite criteria, and we encourage petitioners to submit documentary evidence to support their expedite request.
We review all expedite requests on a case-by-case basis and requests are granted at the discretion of the office leadership.
Why We Are Temporarily Suspending Premium Processing for H-1B Petitions
This temporary suspension will help us to reduce overall H-1B processing times. By temporarily suspending premium processing, we will be able to:
- Process long-pending petitions, which we have currently been unable to process due to the high volume of incoming petitions and the significant surge in premium processing requests over the past few years; and
- Prioritize adjudication of H-1B extension of status cases that are nearing the 240 day mark.
